Ellis, 50, of 810 E. Sheridan is charged with assault with intent to commit murder as the result of a shooting of another man last Oct. 11 in the north parking lot at Fisher Body. The victim, J. W.

Travis, 46, of 818 Jerome was wounded twice by bullets fired from a gun in the hands of Ellis, police detectives said, when Ellis found Travis sitting in an automobile with Mrs. Inez Ellis, 46, wife of the defendant. Kim Sigler, defense counsel, has contended that Ellis was temporarily insane at the time of the shooting. Judge Hayden said the jury could come out with four counts: three if Ellis is adjudged sane, and, of course, "not guilty" if they find him temporarily insane. If the jury finds Ellis was sane at the time.

and Mrs. Ernest Sandborn of Portland; four brothers, George, Harold and Russell of Portland, and Elon of Lansing; a sister, Mrs. Marguerite Fuller of Mulliken. Services will be held Saturday at 12 p. m.

at the Neller funeral home here, with Rev. Keith Avery and Rev. Lowell McCarty officiating. Burial will be in the Portland cemetery. Dies in Sheridan (Special to The State Journal) SHERIDAN, May 2-James P.

Lively, 67, died at his home near here Friday morning. He was born in Mancelona, Feb. 15, 1885, and had resided in this vicinity for 38 years. He married Eva G. Sangines in 1905, and she died in 1940.

He is survived by three daughters, Mrs. Clark Thomson of Germfask, Mrs. Robert Maldonado of Sidney and Mrs. Carl Madsen of Sidney; nine grandchildren; a brother, William Lively of Mancelona, and a sister, Mrs. Rose Hart of Sturgeon Bay.

Services will be held Sunday at 2:30 p. m. at Stebbins funeral home he with Rev. Warren E. Jackson officiating.

Burial will be in Evergreen cemetery here. PONTIAC, May 2 (P)-Fred M. Alger, says that William C. Vandenberg is trying to "inject" the church and prohibition into the Republican gubernatorial primary. The secretary of state assailed his co-Republican in talking to voters at Holly and Birmingham. Vandenberg is a Methodist and an admitted dry. "I am a Presbyterian," Alger said, in response to a question, adding that "there have been many ministers in my family and while a deeply religious man I do not advertise it." Alger said Vandenberg has the support of the Michigan Temperance Foundation, Inc. One of the secretary of state's tour aides said the Temperance Foundation has sent Vandenberg nominating petitions to Methodist ministers, asking their help. also described himself as "firmly opposed" to prohibition.

"My parents," he said, "led the fight for its repeal in the belief that you can't legislate temperance. Temperance is not a matter of legislation but one of restraint." Ex-Conservation Leader Is Dead OSCODA, May 2 UP -James H. MacGillivray, 78, former newspaperman and one of the pioneers in conservation department work in Michigan, died yesterday at Alpena General hospital. MacGillivray was often termed the originator of the Paul Bunyan myths and was described as the founder of the educational division of the Michigan conservation department. He was stricken Wednesday noon when he fell at the Iosco county courthouse at Tawas City.

A native of Ontario, MacGillivray came to Oscoda in 1891. He worked for the Detroit News Tribune for several years and also in Spokane, before returning to Oscoda. He wrote many magazine articles and also a book on forest fire control. MacGillivray was named by the late Gov. Chase Osborn as a member of the public domain commission, forerunner of the present Michigan conservation department.

He was one of the leaders in development of the elaborate system of fire control towers which spot the state's wooded areas.
